Bump stocks

The administration’s change in the regulation regarding bump stocks came to the Supreme Court on a cert. petition.  That petition was denied.  However, the issue is far from over.  In fact, the matter is likely to come back before the Court very soon, and I am not sure that it will stand review.  As for me, I think that any change has to be handled by legislation, not regulation.

Heartbreaking story

Story here.  IMHO the Feres doctrine has been applied to broadly and this would be a great case for the Supreme Court to limit it.

Venezuelan Supreme Court

Looks like one of the Venezuelan Supreme Court Justices has fled the country and denounced President Maduro.  I suspect the end is coming soon for the current government.  It can’t come soon enough to end the suffering of the people.

Stolen Valor

The U.S. Supreme Court has agreed to hear the appeal regarding the constitutionality of the Stolen Valor Act, which makes it a crime to falsely claim military service or awards.  The 9th Cir. had stuck down the act as a violation of the First Amendment freedom of speech.  I’ve had an interest in first amendment law ever since law school.  I’ve though that that the 9th Cir. decision was somewhat suspect.  I’ll be interested in what the Supreme Court does with the case.

Prof. Eugene Volokh has a good analysis of the issues here.

The government abusing the legal system

This is a terrible injustice.  U.S. Attorneys and the courts should not be trying to silence people who simply disagree with the current system, no matter how irritating they are.  The Supreme Court should have taken up the appeal.

Jury duty

Apparently one of the Supremes was called for jury duty.  It is a shame that the Justice wasn’t selected.   I cannot imagine what trying that case would have been like.  Story here.

And, it turns out that our Vice President has also recently been called for jury duty.  Story here.
